Terms and conditions of sale

Purpose

These terms govern the booking and sale, on outdoor66.fr, of guided canyoning, caving, via ferrata and climbing outings. They are issued by OUTDOOR66, SASU with capital of €500, 18 avenue Victor Dalbiez, 66000 Perpignan — SIRET 106 132 376 00018. Any booking constitutes acceptance of these terms. They are available at any time on the site and shown again before payment is confirmed.

Booking and payment

A booking becomes firm once payment is received. Prices are in euros, all taxes included, per person. Sums paid at booking constitute a DOWN PAYMENT (acompte) within the meaning of article 1590 of the French Civil Code, not a deposit (arrhes). The booking therefore binds both parties under the conditions set out below. Payment is handled by Stripe. No card details are stored by Outdoor 66. A confirmation is sent by email once payment is taken, with the meeting point and time.

Right of withdrawal

Under article L221-28 12° of the French Consumer Code, the fourteen-day right of withdrawal DOES NOT APPLY to leisure activity services supplied on a specific date or period. An outing booked for a given date falls within this exception. The booking is therefore not subject to withdrawal, and only the cancellation terms below apply.

Cancellation by the customer

Cancellations must be sent by email to contact@outdoor66.fr or by phone on +33 6 31 25 70 26. The date and time of receipt apply. More than 7 days before the outing: full refund. Between 7 days and 48 hours before: 50% refund. Less than 48 hours before, or failure to attend: no refund. Refunds, where due, are made within 14 days to the payment method used at booking. A booking may be moved to another date or transferred to another person at no charge, subject to availability and to informing Outdoor 66 beforehand.

Cancellation by Outdoor 66

Safety comes before any other consideration. The guide is sole judge of conditions: weather, water level and temperature, ground conditions, and the group's fitness. If conditions do not allow a safe outing, it is cancelled and the customer is REFUNDED IN FULL. An alternative date may be offered, with no obligation to accept it. The customer is informed as early as possible. No compensation beyond the refund of the outing price is due, in particular for travel or accommodation costs incurred.

Gift cards

An Outdoor 66 gift card is valid for twelve months from its date of purchase. It can be used for any outing offered on the site, in one or several times: the unused balance stays attached to the code until it expires. If the chosen outing costs more than the balance, the difference is paid by card. The gift card is not a booking and does not entitle the holder to any particular date. Out of season, departures open on request: the holder suggests a date, which is confirmed depending on the guides' availability. As the gift card is not dated, the buyer has fourteen days from purchase to exercise the right of withdrawal. The card is then refunded in full, provided it has not been used. When an outing paid with a gift card is cancelled, the part paid with the card is credited back to it, not refunded. If the card expires within three months, its validity is extended to three months from the cancellation. Any part paid by bank card is refunded to that card. On expiry, the unused balance is lost. The gift card cannot be exchanged for cash or refunded outside the cases above. No invoice is issued when the gift card is bought: the invoices for the service and the booking fee are issued when it is used.

Participation and safety

Each activity states a minimum age, shown on its page. Minors take part under the responsibility of an accompanying adult or with written authorisation from their legal guardian. Customers undertake to report any medical contraindication, ongoing treatment or circumstance that may affect their safety or that of the group. The information requested at booking is used to prepare suitable equipment. The guide's instructions apply throughout the outing. The guide may exclude any person whose condition or behaviour compromises safety, without refund. Outings are led by professionals holding the State qualifications required for each discipline.

Liability and insurance

Outings are led by independent professional guides holding the State qualifications required for their discipline and, as such, subject to the professional liability insurance obligation set out in the French Sports Code. Supervision, equipment and the conduct of the outing are the guide's responsibility. Outdoor 66 acts as an intermediary: presenting the outings, taking bookings and collecting payment. Its liability is assessed in respect of that service. This cover does not replace personal accident insurance. Customers are advised to check their own cover, in particular for outdoor sports, which some standard policies exclude. Outdoor 66 cannot be held liable for damage to personal belongings, nor for the consequences of inaccurate information given at booking.

Governing law and complaints

These terms are governed by French law. Any complaint should be sent to contact@outdoor66.fr. Outdoor 66 undertakes to reply within fifteen days. Failing an amicable solution, and under article L612-1 of the French Consumer Code, customers may refer the matter free of charge to a consumer mediator. Failing agreement, the French courts have jurisdiction. This is a translation provided for information. In case of discrepancy, the French version of these terms prevails.
